1. Agreement to Terms

Welcome to Brahmaa Kamal ("Brahmaa Kamal", "Company", "we", "our", or "us"). By accessing our website (brahmaakamal.in), purchasing our retail or wholesale spice products, or contacting our culinary desk, you agree to be legally bound by these Terms and Conditions ("Terms"). If you disagree with any part of these Terms, you must not access the website or place orders.

2. Food Products, Purity & Natural Variation

All our whole spices (Royal Shahi Zeera, Kumbhraj Dhaniya, Kashmiri Chili, Golden Turmeric, Kashmiri Saffron, and Royal Garam Masala) are 100% natural agricultural produce sourced directly from trusted Indian farming communities:

• Zero Artificial Alteration: We never apply artificial colorants, synthetic polishes, mineral oils, or chemical anti-caking agents to our whole seeds or powders.
• Natural Harvest Variations: Because our spices are harvested in natural micro-climates, slight variations in color tone, seed size, or oil intensity may occur across distinct seasonal harvests. Such variations are the hallmark of unadulterated farm produce.
• Packaging Integrity: Our spices are packed in food-grade, airtight glass jars or multilayer moisture-barrier pouches with tamper-evident induction seals.

3. Orders, Pricing & Payment Terms

• Order Placement & Acceptance: An order confirmation email/SMS with invoice details constitutes acknowledgment of your order. We reserve the right to decline or limit orders in case of unexpected stock depletion or harvest constraints.
• Transparent Pricing: All retail product prices displayed on the website are in Indian Rupees (INR) and are inclusive of applicable Goods and Services Tax (GST) unless specified otherwise.
• Secure Online Payments: We accept payments via UPI, major Debit/Credit Cards, Net Banking, and authorized digital wallets through end-to-end encrypted payment gateways. We do not store sensitive payment card details.

4. Shipping, Delivery & Transit Safety

We ship across all serviceable pin-codes in India using reputed express logistics partners.

• Dispatch Timeline: Standard orders are dispatched within 24 to 48 business hours of order placement. Transit times typically range from 2 to 5 business days depending on delivery location.
• Tamper-Evident Packaging: Our consignments are packed with branded tamper-proof security tape and sealed containers.
• Inspection upon Delivery: Customers are advised to inspect the outer package at delivery. If the parcel is visibly damaged, leaking, or the security seal is broken, please reject the package and notify us immediately.

5. Returns, Replacements & Food Safety Policy

Due to strict FSSAI food hygiene and safety regulations, edible spice items once opened cannot be returned for restock. However, we offer full replacements under the following conditions:

• Damaged or Tampered in Transit: If your spice container arrives broken, crushed, or with a breached seal, notify us within 48 hours of delivery with clear photographs/video of the package.
• Incorrect Product Delivered: If you received an item different from your order confirmation (e.g., ground powder instead of whole seed), we will dispatch the correct product at zero additional cost.
• Quality Anomaly: In the rare event of a quality defect, our quality assurance team will investigate the batch number and issue a replacement or store credit.

6. Trade, Restaurant & Wholesale Inquiries

For commercial kitchens, hotels, culinary academies, and corporate bulk gifting:

• Wholesale pricing and Minimum Order Quantities (MOQs) are governed by individual Proforma Invoices and trade agreements.
• Commercial buyers must provide a valid GSTIN and FSSAI License copy for commercial invoicing and tax credit input.
• Custom blending and bespoke packaging orders are subject to mutually agreed advance payment schedules.

7. Storage Guidelines & Shelf Life

To preserve the delicate volatile oils (Cumin-Aldehyde in Zeera, Linalool in Dhaniya, Curcumin in Turmeric, Crocin in Saffron):

• Store spices in a cool, dry place away from direct sunlight and humidity.
• Always use a dry spoon; never introduce wet utensils into the spice jar.
• Seal the lid tightly after each use to prevent atmospheric moisture absorption.

8. Intellectual Property & Trademarks

The name Brahmaa Kamal, the sacred floral logo symbol ✦, custom 3D visuals, photography, graphic designs, product descriptions, recipe text, and website source code are the exclusive intellectual property of Brahmaa Kamal and protected under Indian Copyright and Trademark Laws. Unauthorized reproduction or commercial imitation is strictly prohibited.

9. Limitation of Liability

Brahmaa Kamal shall not be liable for any indirect, incidental, or consequential damages resulting from improper storage, delayed delivery due to force majeure events (e.g., severe weather, transit strikes), or individual dietary allergies to specific natural herbs or spices. Customers with known spice sensitivities should review product ingredients carefully.

10. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the substantive laws of India. Any disputes arising out of or related to these Terms, purchases, or services shall be subject to the exclusive jurisdiction of the competent courts in India.
